Things You Should Know About Your Commercial Real Estate Lease - Part 1 “Your Name”
One of the first things you're going to see in the lease is going to be the fact that you have to put your name. Now there are stories out there that all you got to do is put in LLC and your landlord can't sue you.
That is flat-out wrong!
See landlords aren't dumb, they know that they need to make sure they get a personal guarantee so despite you putting an LLC on there they may, if you don't have the financials, require a personal guarantee and that means you default you personally have to back the lease.
Now that's not saying don't have an LLC, certainly, talk to an attorney and see if you need to have an LLC or some other kind of incorporation documents but it's not a safe-all just by having it incorporated.
